01Acceptance of These Terms

These Terms and Conditions govern the use of the YourACAPlan website and every form, message and account feature offered on it. Using this site means accepting the terms set out below in full. Anyone who does not accept them should stop using the site.

These terms apply to visitors who read the site as well as to people who submit a form or open an account.

02What This Site Provides

YourACAPlan is an independent source of guidance about health coverage offered through the Affordable Care Act Marketplace. The site exists to explain plan options in plain language and to help a household work out which plan suits its circumstances.

• Explanations of how Marketplace plans are structured and priced.
• Guidance on premiums, deductibles, copays and yearly spending limits.
• Help reading a plan network and a plan drug list against the doctors and prescriptions already in use.
• Support completing an enrollment request once a plan has been chosen.

This site is not a government agency, is not the Health Insurance Marketplace itself, and is not an insurance carrier.

03Who May Use This Site

This site is intended for residents of the United States who are at least eighteen years of age and legally able to enter into an agreement. Submitting a form is a confirmation that both conditions are met.

04Account Registration

Some features require an account. The person who opens an account is responsible for keeping the password private and for everything done through that account. Any suspected unauthorised use should be reported using the contact details at the end of this page.

An account may be suspended or closed where these terms have been broken or where the information behind it appears to be false.

05Accuracy of the Information You Submit

Guidance offered through this site depends entirely on the details provided. Household size, expected yearly income, current doctors and current prescriptions all change which plans are suitable and what financial help may apply.

Submitting details that are incomplete or inaccurate may lead to guidance that does not fit, and may affect an application made to the Marketplace or to an insurance carrier.

06Contact Permissions and Messaging

By submitting a form and selecting the relevant consent options, a visitor agrees to be contacted about the request that was submitted. Consent for marketing messages is never a condition of receiving guidance or of obtaining coverage.

Message frequency varies. Standard message and data rates may apply. Replying STOP ends further text messages and replying HELP returns support information. Email preferences can be changed by using the unsubscribe link in any message.

07No Insurance Advice or Guarantee of Coverage

Nothing on this site is a binding offer of insurance, a quote, or a promise that a particular plan, premium or level of financial help will be available. Eligibility, plan availability and pricing are set by the Marketplace and by the insurance carriers that issue plans.

The material here is general in nature and is not legal, tax or medical advice. Anyone who needs advice of that kind should consult a qualified professional.

08Relationship With Insurance Carriers

Plans described on this site are issued by licensed insurance carriers. A plan document, a policy and any benefit decision come from the carrier, not from YourACAPlan. Carrier terms control the coverage that is ultimately provided.

09Acceptable Use

This site may be used only for lawful purposes. The following are not permitted:

• Submitting false, stolen or another person's details without permission.
• Attempting to gain access to accounts, systems or data that belong to somebody else.
• Copying, scraping or republishing site content for a commercial purpose.
• Interfering with the operation of the site or with any security measure protecting it.
• Uploading anything that carries malicious code or that is unlawful, abusive or misleading.

10Intellectual Property

The text, layout, graphics and code that make up this site belong to YourACAPlan or are used with permission. They may be read and shared for personal, non commercial use. Any other reproduction requires written permission.

11Third Party Links

This site may link to pages run by other organisations, including the official Health Insurance Marketplace and individual carriers. Those pages carry their own terms and privacy practices. YourACAPlan does not control them and is not responsible for their content.

12Availability of the Site

Reasonable effort goes into keeping this site reachable and up to date. Even so, the site may be unavailable at times for maintenance or for reasons outside anyone's control, and content may be corrected or updated without notice.

13Disclaimer of Warranties

This site and its content are provided as they are, without warranty of any kind, whether express or implied. No warranty is given that the site will be uninterrupted, error free or suited to a particular purpose, to the fullest extent the law allows.

14Limitation of Liability

To the fullest extent permitted by law, YourACAPlan is not liable for indirect, incidental or consequential loss arising from the use of this site, from reliance on its content, or from any inability to reach it.

15Indemnification

Anyone who uses this site agrees to hold YourACAPlan harmless from claims, losses and reasonable costs that arise out of misuse of the site, breach of these terms, or a breach of the rights of another person.

16Changes to These Terms

These terms may be revised as the site changes or as the rules around Marketplace coverage change. The revised version takes effect when it is posted here, and the date shown at the top of this page reflects the most recent revision. Continued use of the site after a revision means the new version has been accepted.

17Governing Law

These terms are governed by the laws of the State of Tennessee, without regard to conflict of law rules. Any dispute that cannot be settled between the parties will be handled in the courts serving that state.
